RameeGo Terms of Use

1. Acceptance of Terms
These Terms of Use ("Terms") govern your use of the RameeGo mobile application ("App") provided by RameeGo, a company operating under the laws of Iraq in Erbil ("RameeGo" "We" "Us" or "Our"). By downloading, accessing, or using the App, you agree to comply with and be bound by these Terms.
2. Use of Application
Your use of the RameeGo App is subject to these Terms. RameeGo provides a platform to connect users with various services including ride-sharing and package delivery. The App facilitates the process of finding and availing of these services which are offered by independent third-party partners ("Service Providers").
3. Account Registration and Management
Before using the App you must agree to these Terms and the Privacy Policy. Registration requires providing necessary information including your full name and valid mobile phone number. Your mobile number is tied to your account and you are responsible for maintaining the security and confidentiality of your account information.
4. Your RameeGo Account
Your RameeGo account is exclusively for your personal use and cannot be transferred or shared with others under any circumstances. RameeGo maintains the right to reject orders if there is a suspicion or knowledge that the account is being accessed or used by someone other than the designated account holder. Safeguarding the security and confidentiality of your account details which include your registered name, mobile number, payment specifics, chosen payment method, and the verification code sent by RameeGo or the Payment Method Provider is entirely your responsibility.
You bear full responsibility for any losses or risks incurred due to negligence in upholding the security and confidentiality of your account information. In instances of unauthorized access or misuse, RameeGo considers any orders or actions conducted through your account as legitimate requests from you. Should you suspect or become aware of unauthorized use, prompt notification to RameeGo is essential.
RameeGo will take immediate and necessary actions to address any instances of unauthorized use, implementing appropriate measures. If you are a Service Provider, using your personal account or utilizing another person's account to order a service that you intend to fulfill as a Service Provider is strictly prohibited.
5. Personal Information
The collection, storage, processing, and sharing of your personal information are governed by the Privacy Policy, an integral part of these Terms.
6. Content and Services
The App may provide access to third-party content and services. RameeGo is not responsible for third-party content and your access to it is subject to its terms and conditions.
7. Rates and Fees
While the App is free to download, certain features may have associated fees. Service rates are outlined in the App, subject to adjustments based on factors like location, time, and applicable laws. Separate fees may apply for package delivery services.
8. Application Software
The official RameeGo App is available on recognized digital markets. Downloading from unofficial sources or using unauthorized devices violates these Terms and RameeGo's intellectual property rights.
9. Intellectual Property Rights
Our application, along with its services, encompasses a variety of elements including names, logos, program codes, designs, trademarks, technologies, databases, business processes, and models. These components are safeguarded by copyright, trademark, patent, and other intellectual property rights as recognized by the laws of Iraq. These rights are registered on behalf of RameeGo and its affiliates.
In adherence to these Terms of Use, we extend to you a limited, non-exclusive, revocable, and non-transferable (without the right to sublicense) license. This license permits you to download, access, and utilize the application solely on your personal mobile phone and/or tablet for the purpose of using our services. Additionally, you are granted access to the content, information, and related materials within the application exclusively for personal, non-commercial purposes. All rights and privileges not explicitly granted herein are reserved by RameeGo and our licensors.
Any unauthorized actions, including but not limited to duplication, distribution, creation of derivative works, sale, or display of the application and/or services, whether digitally or otherwise on devices other than mobile phones or tablets, are considered violations of our intellectual property rights.
You are explicitly prohibited from:
- Deleting any copyright, trademark, or other ownership notices contained in the application or services.
- Copying, modifying, adapting, translating, creating derivative works, distributing, licensing, selling, transferring, displaying in public, reverse engineering, transmitting, moving, broadcasting, decompiling, or disassembling any part of the application.
- Licensing, sublicensing, selling, reselling, removing, transferring, distributing, or commercially exploiting the application and/or software by creating an internet link to the application or framing/mirroring any software on other servers or devices.
- Launching automated programs or scripts that may disrupt the operation and performance of the application.
- Using site searching or retrieval applications, manual or automatic devices for scraping, indexing, surveying, data mining, or any action that interferes with the navigation structure or presentation of the application.
- Publishing, distributing, or reproducing materials that are copyrighted or trademarked without prior written consent from RameeGo or the respective rights owners.
- Using or unofficially accessing the application to damage, weaken, or jeopardize any aspect of the application, services, or related systems and networks, or to create competing products or services that imitate the ideas, features, functions, or graphics of the application.
10. User Responsibility
Users are responsible for their decisions to use the App and its services. Respectful and authorized use is expected and users are liable for losses arising from unauthorized access or misuse.
11. User Conduct Policy
11.1 General Conduct:
Users must conduct themselves in a manner that is respectful and courteous towards RameeGo service providers (drivers and delivery partners), fellow passengers, and RameeGo staff. Any form of harassment, abusive language, or inappropriate behavior is strictly prohibited.
11.2 Compliance with Laws:
Users are required to adhere to all local and national laws while using the RameeGo app and services. This includes but is not limited to traffic laws, public safety regulations, and laws pertaining to the carriage of goods.
11.3 Prohibited Activities:
The following activities are strictly prohibited while using the RameeGo services:
- Violation of privacy rights or sharing of others' personal information without consent.
- Engaging in fraudulent activities or scams.
- Damaging, defacing, or otherwise vandalizing vehicles or property of service providers.
- Using RameeGo for unauthorized commercial activities or solicitations.
- Intentionally providing false or misleading information to RameeGo or service providers.
11.4 Safety and Security:
Users must not carry illegal substances, weapons, or dangerous goods while using RameeGo services.
Actions that compromise the safety of the service provider, other passengers, or the user themselves are prohibited.
11.5 Payment Compliance:
Users are obligated to fulfill payment for services availed as per the stated rates and policies of RameeGo. Avoidance of payment, fraudulent chargebacks, or manipulation of fare estimates are violations of these Terms.
11.6 Account Security:
Users are responsible for maintaining the confidentiality of their RameeGo account details. Sharing accounts with others, unauthorized access, or any form of account misuse is not permitted.
11.7 Reporting Misconduct:
If users observe any breach of these conduct guidelines by service providers or fellow users, they are encouraged to report it to RameeGo immediately through the designated channels within the app or via customer support.
11.8 Consequences of Violation:
Violations of this User Conduct Policy may result in temporary suspension or permanent termination of the user’s account at the sole discretion of RameeGo. In cases of severe violations or illegal activities, RameeGo may also report the matter to relevant authorities.
11.9 Continuous Review:
This policy is subject to regular review and updates as necessary to ensure the highest standards of conduct and service are maintained.
12. Refunds and Cancellation Policy
12.1 Cancellation by Users:
Ride Hailing Services: Users can cancel a ride request within a specified time frame (e.g. 2 minutes) from the time of booking without incurring a charge. Cancellations made after this period may attract a nominal fee to compensate the driver for their time and effort.
Package Delivery Services: For cancellations of package delivery requests, users can cancel a ride request within a specified time frame (e.g. 2 minutes) from the time of booking without incurring a charge. Cancellations made after this period may attract a nominal fee to compensate the driver for their time and effort.
12.2 Refunds:
Faulty Service or Dispute: In cases where the service provided is significantly different from the description or if there is a legitimate dispute (e.g. overcharges, driver misconduct), users may apply for a refund through the app or customer support.
Processing Refunds: Valid refund requests will be processed promptly, with the amount credited back to the user’s original payment method or RameeGo wallet as per the user's preference.
No shows by Service Providers: If a driver or delivery partner fails to show up, the user will automatically receive a full refund without any cancellation fee.
12.3 Cancellation by RameeGo or Service Providers:
Driver Cancellation: If a service provider cancels a request due to unavoidable circumstances, the user will not be charged. RameeGo will endeavor to provide an alternative driver or delivery partner as soon as possible.
System Errors: In the event of cancellations due to system errors or glitches, users will be fully refunded and RameeGo will work to rectify the issue promptly.
12.4 Refund Time Frame:
Refunds will typically be processed within a certain number of business days (e.g. 5-7 business days) depending on the user’s bank or payment service provider.
12.5 Special Circumstances:
In special circumstances such as natural disasters or situations falling under 'Force Majeure', RameeGo will provide flexible cancellation options and waiver of fees.
12.6 Contact and Dispute Resolution:
For any disputes or queries regarding cancellations and refunds, users are encouraged to contact RameeGo customer support. We aim to resolve issues amicably and efficiently, ensuring customer satisfaction.
12.7 Policy Amendments:
RameeGo reserves the right to modify this Refunds and Cancellation Policy. Users will be notified of significant changes via the app or other communication channels.
13. Offers and Payment Methods
13.1 Offers:
Our application may feature offers or promotions ("Offers") provided by third-party offer providers ("Offer Providers"). It's essential to understand that RameeGo is not liable for the quality, accuracy, or any issues related to the offers presented through the application. Your access to and use of these offers are subject to the terms and conditions outlined by us or the respective Offer Providers, including our privacy policy.
Please be aware that Offers are provided by external entities and any concerns or disputes regarding the quality, delivery, or any other issues related to the offers should be addressed directly with the Offer Providers. RameeGo assumes no responsibility for the products, services, or benefits offered by third-party Offer Providers.
13.2 Payment Methods:
Our application facilitates various payment methods to enhance your user experience. It's important to note that these payment methods are provided by independent third-party payment service providers ("Payment Method Providers"). While we strive to ensure a secure and seamless payment process, RameeGo explicitly disclaims responsibility for any issues arising from the use of these third-party payment methods.
If you encounter any problems with the payment methods, we encourage you to reach out to us for assistance. While we may not be directly responsible for the services provided by Payment Method Providers, we are committed to helping resolve any issues and facilitating communication between users and the respective payment service providers.
In case of concerns or disputes related to Offers or Payment Methods, please contact us through the provided channels and we will do our best to assist you in resolving the matter. Your feedback is valuable and we appreciate your understanding of the third-party nature of these services.
14. Limitation of RameeGo's Responsibility
RameeGo provides the App "as is" and is not responsible for Service Provider actions or failures. RameeGo is not liable for delays, failures, or damages arising from internet issues, device problems, or other unforeseen events.
15. Troubleshooting
Users should report system failures, unauthorized account use, or lost/stolen devices promptly. Complaints related to services can be submitted through provided features.
16. Suspension of Account
Your RameeGo account may be subject to suspension under the following circumstances:
- Reported Misuse: If you report that your account has been used or allegedly used by someone else.
- Loss or Compromise: In the event of a reported loss, theft, or hacking of your personal mobile device.
- Transfer or Unauthorized Use: If we have sufficient reasons to suspect that your account has been transferred or used by someone else.
- Harmful Activities: If actions are taken or events occur that in our view may harm RameeGo, you, service providers, or other parties.
- Multiple Accounts Violation: If we know or suspect that you have signed up or logged in to multiple accounts on one device to violate our Terms of Use, Privacy Policy, or applicable laws.
- Unusual Account Activity: If our system detects unusual actions or if obligations under our Terms of Use and/or Privacy Policy are not fulfilled.
- Legal Incapacity: In the case of your death, placement under guardianship, custody, or other legal incapacity according to applicable laws.
- Contrary Use: If you or another party using your account engages in activities contrary to our Terms of Use, Privacy Policy, or applicable laws.
- Government or Court Orders: If your account is suspended based on orders from government or monetary institutions or court orders in accordance with applicable laws.
If your account is suspended and you believe there is clear evidence to refute the suspension, you may report the evidence to us. After a thorough examination of your report, we will at our sole discretion decide whether to end or continue suspending your account. Suspension will not be continued unreasonably if we determine that the issues causing the suspension have been resolved.
Device and Operating System Restrictions:
You must not use the RameeGo application on any device or operating system that has been modified outside the standard configurations. This includes devices that have been "rooted" or "jail-broken."
A rooted or jail-broken device refers to one that has been freed from limitations imposed by your mobile service provider and phone manufacturer without their approval. Using the application on such a device may compromise security and lead to fraudulent transactions.
RameeGo is not liable for the download and use of the application on a rooted or jail-broken device. Such use is entirely at your own risk. We reserve the right to suspend your use of the application on a rooted or jail-broken device and block such devices from accessing the application.
17. Actions Considered Necessary
RameeGo reserves the right to suspend accounts, investigate, and report actions deemed immoral, criminal, or violating these Terms. RameeGo may also facilitate dispute resolution between users and Service Providers.
18. User Representation
Users represent that they have the right to agree to these Terms. Users must access and use the App solely for specified purposes, avoiding fraudulent activities and respecting others' rights.
19. Force Majeure
RameeGo is not liable for interruptions caused by events outside its control ("Force Majeure"). Users release RameeGo from demands and responsibilities related to service facilitation during Force Majeure events.
20. Miscellaneous
These Terms constitute an electronic agreement and user actions such as logging in signify agreement. Users may not transfer their rights without RameeGo's consent. RameeGo may transfer its rights without user approval. Users must not sue the validity of these electronic Terms. This agreement is governed by the laws of Iraq with disputes subject to the exclusive jurisdiction of the North Iraq District Court.
